Building a Strong Case for Appealing a VA Benefits Claim Denial
In order to appeal the decision of the Department of Veterans Affairs regarding your VA disability benefits, you must first build a strong case that clearly proves that you suffer from a disabling medical condition that stems from your time in service. But you do not have to go through the process alone. Our legal team has worked on many cases like yours and can help you gather the necessary evidence to build a strong appeals case.
We may first review your medical history, including your laboratory reports and statements from your doctors, to show you have a disability that changes the way you live your life. We may then review your military records and talk with your friends, family, and those with whom you served to show that your medical condition was the result of an event, illness, or injury that occurred while you were serving your country.
How VA Determines Compensation for Veterans
VA assigns disability ratings to determine the compensation rate to which a veteran is entitled. Ratings are expressed as percentages that represent the extent of your disability and its impact on your ability to function.
The number that VA assigns can range from 0 to 100 percent, with 0 percent qualifying you for benefits like healthcare, but no additional monthly compensation. You must be at least 10 percent disabled to qualify for any tax-free monthly compensation, according to VA. If you are at least 30 percent disabled, you may qualify for additional compensation if you have dependents such as a spouse, children, or parents living in your home.
A disability rating is based on the evidence that you provide to VA, including medical reports from your doctor, lab results, or the results of your VA claim exam, known as compensation and pension exam.
As of December 2019, VA disability compensation levels are:
- 0% disability rating: $0.00 per month
- 10% disability rating: $142.29 per month
- 20% disability rating: $281.27 per month
- 30% disability rating: $435.69 per month
- 40% disability rating: $627.61 per month
- 50% disability rating: $893.43 per month
- 60% disability rating: $1,131.68 per month
- 70% disability rating: $1,426.17 per month
- 80% disability rating: $1,657.80 per month
- 90% disability rating: $1,862.96 per month
- 100% disability rating: $3,106.04 per month
