Building an Appeal for Disability
When the rating specialist handling your application gets your file and obtains the evidence, they will generally look for proof of three things:
- An in-service event, injury, or illness;
- A current diagnosis by a medical professional; and,
- A medical nexus, or link, between your in-service event, injury, or illness and your current diagnosis.
If the VA rating specialist finds that you meet the above requirements, they should grant benefits and calculate a disability rating that, combined with your other service-connected disability ratings, will determine your monthly disability compensation amount.
If the rating specialist believes you do not have the evidence necessary to approve your application, you will likely receive a denial. If this happens to you, reach out to Chisholm Chisholm & Kilpatrick LTD by calling (844) 549-4500. We can review your claim and may be able to help you build a strong case for an appeal.
VA recently instituted new options for disability compensation appeals. Within one year of your denial, you can challenge VA’s decision by:
- Requesting a higher-level review by a senior VA ratings specialist of your application and the supporting evidence you already submitted
- Submitting a supplemental claim that includes new evidence to support your claim
- Filing an appeal and presenting your case to the Board of Veterans’ Appeals in Washington, DC
We can help you determine which option best fits your needs. Because there are strict deadlines on appealing a VA disability denial, it is important that you contact a veterans disability lawyer serving North Carolina about your case as soon as possible after you receive a denial notice.
