Understanding the Evidence Necessary for a Grant of Veterans Benefits

Generally, a grant of service-connected disability benefits requires three things:

  • An in-service event, injury, or illness;
  • A current diagnosis of a disabling condition by a medical professional; and
  • A medical nexus, or link, between your in-service event, injury, or illness and your current diagnosis.

VA must find supporting evidence of these three things in your claims file in order for VA to grant service connection. When helping a veteran build an appeal, we identify and obtain the evidence necessary to prove their eligibility, even if the veteran’s records are inaccurate or missing.

Options for Appealing a VA Disability Benefits Denial

In the past, there was one appeal option for challenging a VA disability denial. In the new appeals system under the Appeals Modernization Act, however, there are three appeal options to choose from depending on which is best for your case:

  • A request for Higher-Level Review: A review of the information already in your file, as conducted by a more senior VA employee;
  • A Supplemental Claim: with this appeal option, you can submit new and relevant evidence to support your claim;
  • A Notice of Disagreement: file your appeal directly to the Board of Veterans’ Appeals and select the appropriate docket depending on your desire for a hearing or to submit new evidence.

Following an initial claim denial, you typically have one year to file an appeal.
