Board Failed To Consider Veteran’s Testimony In Determining Entitlement To Clothing Allowance

The Board found that the Veteran was not entitled to a clothing allowance for the year 2014 because the braces that the Veteran wore for his service-connected knee and back disabilities did not have exposed hinges that tend to damage clothing. The Veteran submitted statements that although his braces did not have hinges, he needed to wear them outside of his clothing to prevent skin irritation and this damaged his clothing. The Court determined that the Board erred when it did not properly consider the Veteran’s lay statements and remanded the case for further adjudication.
