CCK Wins Case for Silver Star Recipient

CCK successfully obtained a remand on behalf of a Marine veteran who is a World War II Silver Star recipient.  The Silver Star is the country’s third highest military decoration for combat valor.  At issue was an increased rating for the veteran’s service-connected PTSD.  The Court agreed with the veteran’s attorneys that it was unclear why the Board had granted an increase effective the date of the veteran’s medical examination, when it is clear his symptoms did not suddenly worsen on that particular date.  The Court held the benefit of the doubt is to be resolved in favor of the veteran on all material issues and remanded the case back to the Board for a new adjudication.
