…The basis of my claim related to a VA ruling that I suffered from Post Traumatic Stress Disease (PTSD). This additional claim was for a ruling that was no longer employable as a result of my PTSD.

After a number of appeals I attended a hearing at the Veterans’ Administration facility at Wissahickon and Manheim Avenues in Philadelphia, PA. There I met with a Board of Veterans’ Appeals Veterans Law Judge. A Disability American Veterans (DAV) representative also attended this hearing. The Veterans Law Judge denied my un-employability claim. The date of denial was April 2, 2019.

Shortly after this denial a representative of Chisolm Chisolm & Kilpatrick LTD (CC&K) contacted me. This firm was referred to me by the DAV. The CC&K representative stated that there was adequate reason to appeal this Veterans’ Administration denial. I agreed to have CC&K represent me, satisfied that this arrangement was to be on a contingency basis.

Over the next 2 plus years CC&K kept in telephone contact with me as they prepared an appeal to this denial. After each communication CC&K would forward a written explanation or clarification of that telephone contact. Each time I spoke with representatives from CC&K found them to courteous, patient and thorough in their explanations and updates.

As a result of the CC&K’s aggressiveness and persistence relating to their appeal efforts, and their knowledge, experience and professional expertise, the Veterans’ Administration issued a favorable ruling in 2019. In addition to a 100% total and permanent disability ruling, I received a significant retroactive benefit amount.

I also had other medical issues relating to exposure to Agent Orange when I served in Vietnam in 1966. CC&K also spent considerable time attempting to get an additional benefit ruling due to these medical issues. Unfortunately, despite continued time-consuming, professional and dedicated efforts, additional benefits were not granted.

My experience with CC&K in their efforts to assist me and the favorable results they achieved has been totally positive and satisfactory. I have been working with the VA for over 8 years to get my disability rating raised to 100%. …I served in the army from September 1968 to September 2, 1970. I received artillery training at Fort Sill Oklahoma on the 105 howitzer. I arrived in Vietnam on February 3, 1969 and was assigned to the 82nd airborne 321 artillery group B- battery. I received a hearing profile while in Vietnam. I then went through two promotion boards, one in Vietnam and another in Colorado. I was the top man for promotions both times but they would not promote me to E-5 unless I gave up the hearing profile. I was discharged from Fort Carson with a hearing disability of 10%. I had to travel to Louisville Kentucky for hearing tests and received hearing aids and 20% hearing loss. In 2006 I filed for PTSD and more hearing loss. I received three C&P psychological test for PTSD. After this I was told to go to a private psychologist with a cost of 500 dollars. He verified that I had PTSD and bi-polar symptoms. Still the Huntington Vet Center denied all my claims. I also joined the Disabled American Veterans. I was going to counseling at the vet center for my PTSD. I also applied for Unemployability. Every time I
was denied compensation. My wife and I also had a conference call with Washington DC with the Veteran Administration. After all the denials, the DAV contacted me in November 2016. This is when my case was turned over to Chisholm Chisholm and Kilpatrick LTD. This is when mistakes were found in my case with the VA. This law firm helped me get compensated for my hearing loss, unemployability and PTSD. The time frame for all of this was from 2006 until Chisholm started my case approximately 2018. I am now receiving 100% disability from the VA due to Chisholm and Chisholm’s diligence and persistence. I would highly recommend Chisholm to other veterans. This long drawn-out process lasted approximately 10 years but I only got results once Chisholm became involved.

Seven years ago I contacted the VA about receiving benefits for agent orange. I was stationed in upper Thailand and Laos border with the army, 809th engineer battalion. I was a Vietnam veteran 1969 to 1970. I came home with many psychological problems which never got better. I had many psych exams which never help at all. Probably 4 or 5 exams if not more! Included in the filings with the VA was a Section 1151 complaint against my primary care doctor at the clinic. I would like to give you a short review of my case for service connected disabilities. After six years of dealing directly with the VA on my own and with a DAV representative, we were basically unsuccessful. I went to many evaluations and was awarded small percentages of disability. My name is Gary[,] I served from Sept 1965 to Dec 1967. I was discharged Dec 1, 1967 with an honorable discharge.

As a seventy two year old, Vietnam Vet, who serve[d] in [the] Marine Core Recon Unit, 13 months combat duty. I had all but, given up, ever getting my claim increased and granted. I contracted with your firm in late November to represent me in the event it was necessary to appeal a decision on my pending Notice of Disagreement regarding a claim for VA disability compensation. While discussing the terms of the contract, I asked your representative, “What happens if my Notice of Disagreement is granted in the next couple months and there is no need for further effort on your part?” She responded that I was welcome to delay the signing of the contract until a decision was received but that at that point she could not guarantee that your firm would be able to represent me at some date in the future.” For this reason, I fully expected to receive an invoice for the agree-upon fee even though if I were completely honest, I would have resented it somewhat, but a contract is a contract. Fair is, after all, fair.

Needless to say I was completely blown away by the phone call I just received from a member of your firm during which he reviewed a number of details regarding the decision letter received and the compensation I would be provided – which was considerable. When he had finished with those details he brought up the fee issue. However, to my complete shock he informed me that your firm was waiving their fee because they had not done any work on my case. I even offered a reduced fee to cover their time, however minimal, on my case. He, again, declined.

I am 72 years old and live on retirement, social security, and (now) the disability payments from the VA. You can only guess what a difference your firm’s decision makes in our lives. I am simply overwhelmed with appreciation for such an honorable and respectful gesture on your part. I have, in general terms, related this experience on at least three discussion groups relating to VA claims and hope by doing so you are recognized as a highly ethical and dedicated servant of our country’s veterans. Sirs. My dealings with VA began 40 yrs ago. My first claim was for my hearing after 6 yrs of submarine duty standing long watches in ENG. RM. Without hearing protection. I was rejected and threw in the trash. I firmly believe that this is what VA wants!

I next filed an appeal about my broken neck in1967 car wreck. They rejected it but gave me 10% on ears. I appealed and finally got 20% which is where it remains today.
After about 20 yrs of seeing VA shrinks, a clerk at FT. Smith Clink asked if I filled for my travel day. Told him I did [not] get T.P. He asked how long I had been seeing shrink. Told how long and he [flipped] out and gave me claim papers. I was turned down and filed [an] appeal [and] got 30%.

About this time the D.A.V notified me that you had reviewed my case and thought you could win.

And win it you did!!! I am now 80% with 100% pay and all military base privileges.

But that was not enough for you. You found that VA had not gone back far enough on claim and got a large back pay.

Stolz and your attorneys submitted a very excellent and substantiated appeal containing credible evidence of my duty location, associated duties, and documentation of my service at Udorn AFB as a Munitions Supply Officer. I couldn’t have expected a better outcome for my complicated VA disability claim than what I obtained working with Chisholm, Chisholm & Kilpatrick (CCK). On a scale of 1 to 10, I would give CCK a 10.1! Back in the mid 1990’s, I tried to pursue my disability claim on my own. I thought I knew enough about the VA claims process to be successful but I wasn’t. Between 1995 and 2007, I made about 4 attempts to obtain my benefits, all without success. I decided to get serious about my claim in 2007 and I did what I could but after the initial denial, I searched for and hired CCK whom had been highly recommended to me. The team there took over my case made strong arguments on my behalf. Even though it took me almost nine years to realize satisfaction of my claim the delays were due to VA and repeated appeals. The firm was tenacious with the VA on my behalf and constantly followed up with the VA pressing for action. I was a little skeptical at first because I lived in Tennessee and CCK is in Rhode Island, but the distance proved to be no issue at all. Over the course of my claim I had multiple hearings and two stand out in my mind in particular because CCK was just stellar. Mr. Chisholm (by telephone) and Mr. Baker (in person) commanded the hearings and carefully guided my testimony. They did not tell me what to say but guided me into timely discussing what was pertinent and relevant. Every member of the firm’s staff I worked with over the years was knowledgeable and most professional. The firm must without a doubt be the finest veterans’ legal advocates in the country! In 2011, I was granted 100% permanent and total disability. I was happy with the result and was ready to accept the results as final, but CCK took another look and told me that the VA need to go back in time and pay on my claim.
