CCK Wins Remand In Case Of Veteran Who Suffers From Radiculopathy In Extremities

Chisholm, Chisholm & Kilpatrick recently won a remand in the case of an Army veteran who served in the 1970s and suffers from radiculopathy in his extremities.  The Court agreed that the Board failed to clearly explain the criteria used when determining whether a disability is “mild” or “moderate.”  The Court ordered a remand for the Board to determine whether the totality of the veteran’s symptoms, at any time during the relevant appeal period, supported an increased rating.
