CCK Wins Case For Marine

CCK recently won a favorable decision at the United States Court of Appeals for Veterans Claims on behalf of a Marine Veteran who served in the 1960s. VA granted him a 0% rating for hearing loss, but denied an increased rating, and denied referral for extraschedular consideration. On appeal, the Veteran’s attorneys argued that, in addition to hearing loss, he suffered from dizziness, loss of balance, and earaches, which the Board did not weigh in making its decision. The Court agreed, and remanded the claim back to the Board to obtain a medical opinion to determine whether these symptoms are related to the hearing loss, and to readjudicate the Veteran’s entitlement to extraschedular referral in light of those findings.
