CCK Settles Case For Air Force Veteran

CCK has successfully settled a claim on behalf of an Air Force veteran seeking service connection for prostate and laryngeal cancers, to include as due to herbicide exposure. The veteran had submitted statements explaining his duties while stationed in Thailand in the 1960s required him to be near the air base perimeter. The Board of Veterans’ Appeals specifically found his statements to be credible, but nonetheless denied service connection, finding no evidence of “actual exposure” to herbicides. On appeal to the United States Court of Appeals for Veterans Claims, CCK contacted VA and persuaded their Office of General Counsel that the Board had misapplied the law and settlement was warranted. The settlement will result in a retroactive grant of benefits for the veteran.
