CCK Gets Veteran’s 100% Rating Restored

An Army veteran had been receiving a 100-percent rating for Non-Hodgkin Lymphoma for 17 years when the Board suddenly reduced his rating to 10-percent. CCK took the case to the United States Court of Appeals for Veterans Claims through the DAV CCK Pro Bono Veterans Court Program, and persuaded VA’s Office of General Counsel that a remand was necessary for the Board to adequately explain the reduction. On remand, CCK responded with a legal argument as to why the reduction was not warranted, and the Board restored the veteran’s 100-percent rating retroactively.
